‘With regard to your request for a meeting with the Chief Fire Officer, it is clear from your fax that the matter involves pending disciplinary proceedings against you. I therefore consider that, as the Chief fire Officer is likely to preside over those disciplinary proceedings, it may compromise his impartiality for him to meet you at this time.’

Doh! Bearing in mind the material circumstances of the discipline prosecution concern a matter of litigation in the County Court where Firefighter Hyde and the CFO Mr M Alcock were adversarial parties the above would be very controversial and potentially unsafe?

And of course liability in favour of Firefighter Hyde had already been admitted by Suffolk County Council. (see Doc 69

I am in receipt of your letter to the Chief Fire Officer dated 15 April 1999 and faxed to these Headquarters on the same date.
In respect of your complaint, I have spoken to Mr Jackson, the secretary to the disciplinary tribunal. He advises me that he spoke to both Mr Morton of Counsel and the solicitor from Thompson’s immediately after the alleged incident was reported. He confirms that Mr Morton was advised that, as the alleged incident occurred on County Council premises, any representations you wished to make should be directed to the Chief Executive of the County Council for her consideration as to the proper course of action. For your convenience, and in order that there should be no delay, I have forwarded a copy of your fax to the Chief Executive today.
With regard to your request for a meeting with the Chief Fire Officer, it is clear from your fax that the matter involves pending disciplinary proceedings against you. This was prepared on behalf of Firefighter Hyde by Mr Craig Jones of Thompson’s solicitors. This was subsequent to the application for FBU legal aid made and approved 16th April 1999 Mr Jones was not aware that firefighter Hyde had already accepted the offer of liability and compensation offered by Suffolk County Council. From recollection the process set out in the consent order was designed so as not to exclude further litigation on the breach of contract issue.
